Dr. Gunnar Beck: Rechtsmittel werden geprüft!

Obwohl die Richterin beim Amtsgericht Neuss in der Hauptverhandlung am 14.06.2022 erneut eine Verfahrenseinstellung angeregt hatte, scheiterte diese an der Ablehnung der Staatsanwältin. Stattdessen setzte die Richterin im Urteil wegen unbefugter Titelführung die Geldstrafe gegenüber der im vorangegangenen Strafbefehl erheblich herab. Die Verteidigung hatte Freispruch gefordert und prüft nun Rechtsmittel gegen diese Entscheidung.

Zur Erläuterung:

Im Zusammenhang mit meiner langjährigen wissenschaftlichen und Lehrtätigkeit in Oxford und London hat der Wahlprüfungsausschuss des Deutschen Bundestages festgestellt, dass in meinem Falle „[j]edenfalls eine langjährige Tätigkeit als Hochschuldozent ... für eine besondere wissenschaftliche Qualifikation [spricht], so dass etwaige diesbezügliche Erwartungen der Wähler durchaus ihre Berechtigung hatten.“^[1] Zur Frage der Übersetzung ins Deutsche meiner britischen Berufsbezeichung als ‘Reader of EU law and Legal Theory’ verweise ich auf die Äquivalenztabelle in Wikipedia^[2].

Legal remedies are being considered!

Although the judge at the Neuss Local Court wanted yet again to drop the charges, at the main hearing on June 14 2022, this failed due to the prosecutor's refusal. Instead, in the judgement for unauthorised use of title, the judge considerably reduced the fine compared to the previous one. The defence had demanded acquittal and is now considering appeals against this decision.

By way of explanation:

In connection with my many years of academic and teaching activity in Oxford and London, the Election Review Committee of the German Bundestag found that in my case "[j]ust as many years of activity as a university lecturer...speaks for a special academic qualification, so that any expectations of the voters in this respect were quite justified."^[1] Regarding the issue of German translation of my British professional title as 'Reader of EU law and Legal Theory', I refer to Wikipedia's equivalence^[2].
